1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BoldHause Studio ("we," "us," or "our") governing your access to and use of the BoldHause Studio platform, website, and services (collectively, the "Services"), located at boldhausestudio.com.

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

3. Accounts and Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscriptions and Payments

BoldHause Studio offers both free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your chosen payment method for all applicable fees. All payments are processed by Stripe and are subject to Stripe's terms and privacy policy.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial months.

5. Intellectual Property

BoldHause Studio retains all rights, title, and interest in and to the Services, including all software, designs, trademarks, and content provided by us. You retain all rights to the brand outputs, copy, and creative materials generated during your sessions on the platform.

You grant us a limited license to use your brand session inputs solely for the purpose of providing the Services, including processing through third-party AI services.

6. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Infringe upon the intellectual property rights of others
• Transmit harmful code, malware, or viruses
• Attempt to gain unauthorized access to the platform or other users' accounts
• Use the platform to generate unlawful, defamatory, harassing, or discriminatory content
• Interfere with or disrupt the integrity or performance of the Services

We reserve the right to suspend or terminate your account for violations of these rules.

7. Third-Party Services

The Services integrate with third-party providers including Stripe (payments), Clerk (authentication), Anthropic (AI processing), Beehiiv (email marketing), Cal.com (scheduling), and Supabase (database). Your use of these integrated services is subject to their respective terms and policies.

8. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

BoldHause does not guarantee that the Services will be uninterrupted, secure, or error-free. AI-generated outputs are provided for guidance and creative inspiration and should be reviewed by you before use in commercial or legal contexts.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLDHAUSE STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless BoldHause Studio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Alabama.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the platform. Continued use of the Services after changes constitutes acceptance of the updated Terms.
